These Terms and Conditions (the "Agreement") constitute a legally binding contract between NXT 100 Awards (the "Organizer") and the individual or entity registering for the competition (the "Entrant" or "User"). By accessing the website, registering for the awards, or submitting an entry, you acknowledge that you have read, understood, and agreed to be bound by these terms.

Eligibility and Registration

1.1  Professional Status

The NXT 100 Awards is a "Design Recognition" competition primarily for young architects. Participation is restricted to individuals who have obtained a Bachelor of Architecture (B.Arch) or equivalent degree from a Council of Architecture (CoA) recognized institution within the last six (6) academic years.

1.2  Conflicts of Interest

Employees of the Organizer, members of the appointed Jury, and their immediate family members or business associates are prohibited from entering.

Submission Guidelines and Integrity

2.1  Anonymity - The "URN" Rule

To ensure absolute impartiality, all submissions must be identified only by a Unique Registration Number (URN) provided upon completion of registration. Any digital board, image, narrative, or file containing names, logos, firm watermarks, or identifying marks will result in immediate and automatic disqualification.

2.2  Modification and Finality

Once the "Final Submission" is uploaded, no further edits, revisions, or replacements are permitted. The Organizer is under no obligation to notify an entrant of a failed or disqualified submission.

2.3  AI Disclosure

Entrants may utilize Generative Artificial Intelligence (AI) tools for designing or visualization process. While AI may be used as a supplementary tool, the core architectural concept and design logic must be the original intellectual work of the Entrant.

3.

Intellectual Property and Licensing

3.1  Ownership of Copyright

In accordance with the Indian Copyright Act, 1957, ownership of the copyright in all submissions remains with the author(s).

3.2  Grant of License

By entering, the Entrant grants the Organizer a worldwide, irrevocable, royalty-free, and sub-licensable license in perpetuity to:

  • Reproduce, publish, and distribute the submission in any media (print, digital, social media).
  • Use the submission for promotional, archival, and exhibition purposes.
  • Modify or adapt the submission for layout and publication requirements.
3.3  Waiver of Moral Rights

The Entrant hereby waives all moral rights to the maximum extent permitted by law to facilitate the publication and promotion of the Awards.

4.

Evaluation and Jury Discretion

4.1  Finality of Decision

The determination of the Jury panel is final and binding on all parties. No correspondence, appeals, or legal challenges regarding the Jury's subjective evaluation will be entertained.

4.2  Right to Not Award

The Jury and Organizer reserve the right to not award a prize in any category if the submissions do not meet the minimum professional or creative standards required.

5.

Financial Terms and Prize Disbursement

5.1  Registration Fees

All registration and submission fees are non-refundable and non-transferable, regardless of disqualification, withdrawal, or rescheduling of the competition.

5.2  Prize Forfeiture

Winners must respond to the official award notification and provide all requested documentation (ID, Degree Proof, Bank Details) within fourteen (14) days. Failure to comply will result in the immediate forfeiture of the prize, which may then be awarded to the next-highest-ranked entrant.

5.3  Bank and Tax Compliance

Prize money will only be disbursed to a bank account exactly matching the name of the registered Team Leader or Individual. All applicable central and state taxes (TDS) are the sole responsibility of the winner.

5.4  Physical Trophies and Delivery

Winners eligible for a physical trophy shall be notified via their registered email address and are required to submit a complete and accurate physical shipping address in India within fourteen (14) days of receipt of such notification. The Organizer expressly disclaims any liability for non-delivery or loss of the award arising from inaccurate address information, the absence of the recipient at the time of delivery, or logistical failures beyond the Organizer's reasonable control.

6.

Representations, Warranties, and Indemnity

6.1  Plagiarism Warranty

The Entrant warrants that the submission is their original work and does not infringe upon the intellectual property, privacy, or moral rights of any third party. If charges of plagiarism are brought, the Entrant must address them at their own expense; the Organizer reserves the right to remove the content during the dispute.

6.2  General Indemnity

The Entrant agrees to indemnify and hold harmless the Organizer and its agents against all claims, damages, losses, and legal fees arising from a breach of this Agreement.

6.3  Recovery of Costs

Should an Entrant initiate legal action against the Organizer and fail, the Entrant shall be liable to pay the Organizer's full legal costs and reasonable attorney fees.

7.

Data Protection - DPDP Act 2023

The Organizer processes personal data in compliance with the Digital Personal Data Protection Act, 2023 (India). By registering, the Entrant provides clear affirmative consent for the collection and processing of their data for the purposes of competition administration, verification of eligibility, and promotional publication.

8.

General Provisions

8.1  Force Majeure

The Organizer shall not be liable for any failure to perform its obligations due to events beyond its reasonable control, including but not limited to acts of God, pandemic restrictions, government actions, or technical failures.

8.2  Amendments and Timeline Changes

The Organizer reserves the right to amend these Terms, competition deadlines, or award categories at any time without prior notice. Entrants are responsible for checking the official website for updates.

8.3  Nature of Competition

The NXT 100 Awards is a "Design Recognition" competition. Winning an award does not imply a contract for professional services or an intention for the proposal to be physically constructed.

9.

Governing Law and Dispute Resolution

9.1  Governing Law

This Agreement is governed by and construed in accordance with the Laws of the Republic of India.

9.2  Arbitration

Any dispute arising out of this Agreement shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996.

  • Seat of Arbitration: To the choosing of the Organizer.
  • Language: English.
  • Jurisdiction: Subject to arbitration, the courts of the seat of arbitration shall have exclusive jurisdiction.
